What "Unlimited" means :
Unlimited Disk Space/Bandwidth/Website Plans. This means that we do not set a limit on the amount of bandwidth, websites or disk space you may use in the normal operation of a personal or small business website, provided it complies with this Agreement. However, in the event your service usage or content presents a risk to the stability, performance or uptime of our servers, data storage, networking or other infrastructure, you may be required to upgrade to a VPS, or we may take action to restrict the resources your website is utilizing.
What "Unlimited" DOES NOT mean
We employs complex mechanisms to protect its hosting Subscribers and systems from any kind of abuse. Our Webhosting Solution's "Unlimited" hosting offering is not for single or few hosting subscribers to unfairly or adversely impact the experience of other hosting Subscribers. Our Webhosting Solution's service is offering shared hosting service, which means that multiple hosting Subscriber's websites are hosted from the same server and share server resources. Our Webhosting Solution's service is designed to meet the typical needs of small and medium sized businesses across globe. It is NOT intended to support the sustained demand of large enterprises, or non-typical applications better suited to a VPS or a dedicated server. Our Webhosting Solution will make every commercially reasonable effort to provide additional resources to Subscribers who are using their website(s) consistent with these Terms, including moving Subscribers to newer and bigger shared servers as necessary. However, in order to ensure a consistent and quality experience for all Subscribers, Our Webhosting Solution does place automated safeguards to protect against any website growing too quickly and adversely impacting the system until Our Webhosting Solution can evaluate said sites resource needs.
Unlimited Hosting Space
excessive SQL Database Our Webhosting Solution does not set any specific limits on the amount of disk space a hosting subscriber can use for their website, nor does Our Webhosting Solution charge additional fees based on an increased amount of storage used, provided the hosting subscriber's use of storage complies with these Terms. Please note, however, that the Our Webhosting Solution service is designed to host websites. Our Webhosting Solution does NOT provide unlimited hosting for online storage, videos, images, audio, games, installers, executable files, backups, or archiving of electronic files, documents, log files, web spider or indexer, irc, torrent, file sharing, peer-to-peer activities, testing environment etc., and any such prohibited use of the Services will result in the termination of hosting subscriber's account, with or without notice. Accounts with an excessive database size (i.e., more than 1 GB) negatively affect the performance of the server. Our Webhosting Solution may request that the database size be reduced to ensure proper performance or may disable the Subscriber's account, with or without notice. Hosting subscriber's can create multiple databases however size of each database should not be more than 1 GB.
Unlimited File Transfer
Our Webhosting Solution does not set any limits on the amount of visitor traffic a website can receive or on the amount of content a hosting subscriber can upload to his/her/its website in a given month, nor does Our Webhosting Solution charge additional fees based on increased use of bandwidth, as long as the hosting subscriber's use of the Services complies with these Terms. In most cases, a hosting subscriber's website will be able to support as much traffic as the hosting subscriber can legitimately acquire. However, Our Webhosting Solution reserves the right to limit processor time, bandwidth, processes, or memory in cases where it is necessary to prevent negatively impacting other hosting subscribers.
Unacceptable Resource Usage
Run cron entries with intervals of less than fifteen (15) minutes.
Run any MySQL queries longer than sixty (60) seconds.
Using morethan the Allocation resource will result your website with Resource Limit Exceeded error.We will check for such logs weekly once and Accounts with high number of Faults (Exceeded) will be suspended and Given with Single IP Access until It was optimized to use Below.If we get such type of exceeds multiple times you should consider taking VPS/Dedicated Server as per your Usage needs.
The Email usage should not exceed 2 GB Per Hosting.
"Unlimited" usage policies and definitions apply to All the Shared Environment Plans Shared/Reseller/Master/Alpha Reseller Hosting Plans.
Server Resource Usage :
The space on the shared environment hosting packages can only be utilized for web files, and hosting a user's website. This space should not be used for media storage or for storing other data such as storing electronic files, saving website backup, FTP host or for demo purposes. We hold the right to inspect every shared hosting account for extra utilization of disk space, CPU and other resources that may be violated of this Agreement or the AUP.
We may terminate access to the Services at our sole discretion, or takedown or erase User Content for those accounts considered to be in violation of these Terms and Conditions and other policies. Dedicated and VPS usage limits will depend on the amount of resources allocated to the plan that you have purchased.
Every Accounts created on the shared Environment (By you/yours Resellers) Should not exceed the Below allocation.Exceeding the LVE Allocation by any Account/Hosting under the server will result in that corresponding account suspension with/without notice.
Welcome. These Terms and Conditions ("Terms", "Terms and Conditions") govern your use of our web hosting services ("Services"). By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
We strictly prohibit any websites or content that promotes illegal activities or presents content that may damage our servers or any other servers on the Internet. Linking to such materials is also strictly prohibited. Any attempt to undermine or cause harm to our servers is strictly forbidden, and detection of such activities may result in service suspension without prior notice. We hold the authority to suspend your account without refund if we detect any malicious activities. Server abuse includes, but is not limited to, the following
1.1. CPU/Resource intensive programs
1.2. Denial of Service (DoS) Attacks
1.3. Hacking/cracking of any kind (including exploits)
1.4. Account trading
1.5. Spamming
1.6. Transmission, storage, or distribution of any information, data, or material in violation of any law or regulation, including copyrighted material, trademarks, or any other illegal content. Examples include, but are not limited to, movies, MP3s, pirated software, hacker programs, or warez sites.
1.7. IRC on our VPS and shared servers
1.8. Warez, image/file dump, mirror, or ad services
1.9. Sale of controlled substances or online pharmacies
1.10. Autosurf sites, investment sites, escrow, HYIP, bank debenture programs, or lottery sites
1.11. Brute force programs, IP scanners, mail bombers, and spam scripts
1.12. Phishing
1.13. We do allow game servers on our VPS accounts, provided they follow our server resource policy. Personal proxies are allowed.
If we determine that you have engaged in any of the above activities, or any other activities that we deem harmful or abusive, we reserve the right to take immediate action, which may include:
Suspension or termination of your account.
Removal of any content that violates our policies.
Reporting your activities to the appropriate authorities.
#2. Domain Hijacking2.1. Responsibility Disclaimer:
- We are not responsible for any domain hijacking or unauthorized access. This includes financial losses, data losses, or operational disruptions.
2.2. Theft Protection Requirement:
- You must purchase and maintain theft protection services to secure your domain. Details and costs will be provided at registration or renewal.
2.3. Customer Responsibility:
- You are responsible for the security of your domain credentials and must report any suspicious activity or security breaches promptly.
2.4. Limitation of Liability:
- We are not liable for any damages resulting from domain hijacking. Our liability is limited to the amount paid for theft protection services during the affected period.
#3. Cancellation Policy3.1. Right to Cancel:
- We reserves the right to cancel any service at any time under certain circumstances. If the suspension or cancellation of services is due to a policy violation, you are not eligible for a refund under any circumstances.3.2. Customer-Initiated Cancellation:
- Customers can cancel any service at any time. However, no refund will be provided if the cancellation is requested after 7 days of purchase (only for Managed Web/Shared Hosting). No refunds will be provided for VPS and dedicated or custom plans.
3.3. Unintentional Recurring Payments:
- If you cancel your account and your payments continue to recur for any reason, such as:- By mistake of our staff.
- By an error of the credit card processor.
- By an error of any other payment collection company.
- We are to be held free of liability for any overdraft fees that are issued by your financial institution. All the licenses provided with services and add-ons are non-refundable.
#4. Storage Policy4.1. You cannot host video or music sites. Our hosting services are optimized for websites that do not require extensive bandwidth for streaming or downloading multimedia content. Hosting video or music files can negatively impact server performance and is not permitted.
4.2. You cannot use our web hosting for storage. Our services are designed for hosting websites, not as a general storage solution. Storing large amounts of non-website related data is prohibited.
4.3. You cannot use our web hosting for backing up your files. Our hosting solutions are not intended for data backup purposes. Please use dedicated backup services to secure your data.
4.4. You cannot upload multiple large files. To maintain optimal server performance and fair use among all customers, the upload of numerous large files is restricted. Please ensure your uploads are necessary and relevant to your website.
4.5. Every email account has a maximum storage size of 512MB. This limit helps ensure that email services remain efficient and reliable. Please regularly manage your email storage to avoid disruptions.
#5. Content Policy5.1. Hosting content that promotes any adult content, video sites, music sites, or any racist content (including but not limited to color, religion, creed, or any beliefs) will result in immediate suspension of services.
5.2. You can't use web hosting as a file hosting service to store your files.
5.3. Cron jobs are allowed at a minimum interval of 15 minutes. If you use it for less than 15 minutes, we reserve the right to suspend your hosting account.
#6. Uptime GuaranteeOur Internet strives to provide a reliable and high-quality web hosting service. However, there are certain situations where service interruptions or downtime may occur. These situations are outlined below:
6.1. Scheduled Maintenance
Any service interruptions or downtime due to scheduled maintenance by Us or our network providers will not count towards the uptime guarantee. We will make every effort to notify customers in advance of any scheduled maintenance that may affect the availability of our services.
6.2. Third-Party Service Failures
We are not liable in any way for failures of third-party services. This includes, but is not limited to, issues such as:
Apache server downtime
LiteSpeed server downtime
Failures of any other third-party software or services used in conjunction with our hosting services
6.3. Force Majeure
We will not be liable for any failure or delay in performing its obligations if such failure or delay is due to circumstances beyond our reasonable control. These circumstances include, but are not limited to:
Acts of any governmental body
War, insurrection, sabotage, or embargo
Fire, flood, or other natural disasters
Strikes or other labor disturbances
Interruptions or delays in transportation
Unavailability or interruptions in telecommunications or third-party services (including DNS propagation)
Failure of third-party software or hardware
Inability to obtain raw materials, supplies, or power necessary for the provision of our services
In such events, We make reasonable efforts to mitigate the effects of the force majeure event and resume services as soon as possible.
#7. Adult ContentOur web hosting service strictly prohibits the hosting or distribution of adult content, including but not limited to, pornography, sexually explicit material, and any content deemed inappropriate for minors. If you are found to be hosting or distributing adult content on your website, your service will be terminated immediately without any notice.
We reserve the right to determine what constitutes adult content and to enforce this policy at our discretion. If you have any questions regarding this policy, please contact our support team for clarification.
#8. Backups and Data PolicyWe do not provide data backups for your account. It is your responsibility to maintain regular backups of your website data and content. We are not liable for any data loss or damage, including but not limited to data corruption, accidental deletion, or hardware failure.
We strongly advise all our clients to implement their own backup solutions to ensure the safety of their data. While we employ various security measures to protect your data, it is essential to take additional precautions to safeguard your information. By using our services, you agree to take full responsibility for your data backups and acknowledge that we shall not be held accountable for any data loss or related consequences.
#9. Copyrighted ContentWe are committed to respecting and protecting the intellectual property rights of others. By using our services, you agree to the following terms regarding copyrighted content:
9.1. You must ensure that any content you upload, store, or distribute through our services does not violate any copyright laws. This includes, but is not limited to, text, images, videos, music, software, and any other type of media or intellectual property.
9.2. If you do not have the necessary rights or permissions to use copyrighted content, you are prohibited from uploading, storing, or distributing it through our services.
9.3. We reserve the right to immediately terminate your account and access to our services if we determine, at our sole discretion, that you have infringed upon the intellectual property rights of others. This termination will occur without prior notice.
9.4. In addition to termination of services, we may also remove or disable access to any infringing content, and we may report the infringement to the relevant authorities or parties.
9.5. You agree to indemnify and hold us harmless from any claims, damages, or expenses, including reasonable attorneys' fees, arising out of or related to your violation of these terms regarding copyrighted content.
We take copyright infringement seriously and strive to ensure that our platform remains a safe and lawful environment for all users. If you upload or use any copyrighted content without proper authorization, your service will be terminated immediately without any notice.
#10. Spam / Mail PolicyWe do not allow spam or bulk emailing under any circumstances. You cannot use our servers or services for bulk or unsolicited emails. You can send up to 100 messages per hour with your account. Subscribing email addresses to any mailing list without the express permission of the email address owner is prohibited. All mailing lists run on our servers must be Closed-loop (Confirmed Opt-in). Users may be charged a fee of ₹30,000 or more for blacklist removal.
#11. Payment InformationBy signing up for our services, you agree to pay us the recurring subscription fees as specified in your order. Failure to pay these fees may result in the suspension or termination of your services.
#12. Account Setup and EmailWe will set up your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address that is not @ the domain(s) you are signing up under.
#13. Data Migration PolicyWe does not offer migration assistance for any hosting services. Customers are responsible for handling their own migrations independently.
#14. Refusal of ServiceWe reserve the right to refuse, cancel, or suspend service at our sole discretion.
#15. LegalWe holds the right to change prices, policies, and configurations of any account when needed without prior notice.
We expect our customers to abide by all our rules and applicable laws. Failure to comply with those laws will violate our policy. By signing the service agreement, subscribers indemnify us for any violation of the service agreement, law, or our policy that results in loss to us or the bringing of any claim against us by any third-party. This means that if we were sued because of a subscriber’s or a customer of a subscriber’s activity, the subscriber will pay any damages awarded against us, plus costs and reasonable attorneys’ fees.
#16. Updates to TermsWe may update these Terms at any time. Changes will take effect immediately upon being posted on our website. By continuing to use our services after changes are posted, you agree to the revised Terms.
